Gautam Adani along with Sagar Adani have agreed to receive the legal notice issued by the U.S.-based Securities and Exchange Commission (SEC). Information has emerged that lawyers representing them have filed affidavits in court to this effect. This has now become a key development in the case registered in the United States. Over the past few months, the Indian government had refused to serve notices to Gautam Adani, a leading industrialist in the country, and Sagar Adani, citing various reasons. With no other option left, the SEC approached a U.S. court seeking permission to serve notices through email. It is now being said that the Adanis, realizing that this matter could take another turn, have agreed to receive the notices through their lawyers.
This was mentioned in a petition filed in the Brooklyn Federal Court in New York. According to it, U.S.-based lawyers representing Gautam Adani and Sagar Adani have agreed to accept the regulator’s legal documents. Experts say this removes the need for a judge to rule on how notices should be served to the defendants. This joint application has been submitted for approval to the concerned court. This is a procedure commonly followed in U.S. legal proceedings. If the judge grants approval, the joint application will pave the way for the SEC matter to move forward. As per this, the Adanis will get 90 days to seek dismissal of the case or to present their defence arguments.
After that, the SEC can file its reply within another 60 days. The Adanis will then be given another 45 days to file their responses. Allegations have been made that Adani Green Energy Limited (AGEL), part of the Adani Group, paid bribes exceeding ₹2,200 crore to political leaders and officials to secure various projects in India. However, the Adani Group had rejected these allegations at the time itself, stating that they were completely baseless. To defend himself and argue the case, Gautam Adani has appointed prominent Wall Street lawyer Robert Giuffra Jr. He has also served as a lawyer for U.S. President Donald Trump in various cases. Robert Giuffra Jr., co-chairman of the reputed law firm Sullivan & Cromwell, informed a federal judge that he has reached an agreement to accept the lawsuit on behalf of Gautam and Sagar Adani.
